Welcome to Profile Info ("Service," "Platform," "we," "us," or "our"). These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Profile Info Ltd., governing your access to and use of the Profile Info website, applications, software, products, and services (collectively, the "Services"). By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional guidelines, policies, and future modifications. If you are using the Services on behalf of a company, organization, government, or other legal entity ("Organization"), you represent and warrant that you have the authority to bind that Organization to these Terms, and references to "you" and "your" will refer to both you as an individual and the Organization.
You must be at least 16 years of age to use the Services. By agreeing to these Terms, you represent and warrant that: (a) you are at least 16 years old; (b) you have not previously been suspended or removed from the Services; and (c) your registration and your use of the Services is in compliance with all applicable laws and regulations. If you are under 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Services under the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
Profile Info reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time. We will provide notice of material changes by: (a) posting the revised Terms on our website with an updated "Last Updated" date; (b) sending a notification to the email address associated with your account; or (c) displaying a prominent notice within the Services themselves. Your continued use of the Services following the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Services and may terminate your account as described in Section 12 (Termination). It is your responsibility to review these Terms periodically for changes.
Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, and share your personal information, and our Cookie Policy, which explains our use of cookies and similar tracking technologies. These documents are expressly incorporated by reference into these Terms. In the event of a conflict between these Terms and any supplemental policy, these Terms shall govern. Certain features or services may be subject to additional terms, guidelines, or rules ("Supplemental Terms") that will be presented to you in connection with such features. All Supplemental Terms are incorporated by reference into these Terms.
Profile Info is a Software-as-a-Service (SaaS) platform that enables users to create, manage, and publish a centralized digital profile ("Profile" or "Profile Page"). The Service provides tools for aggregation, presentation, and analytics, allowing you to consolidate content from various online sources, display it in a customizable format, and share it via a unique Profile Info URL or a custom domain you connect.
The Services include, but are not limited to:
Profile Creation & Management: A visual editor using a modular block system to add, arrange, and customize content such as text, images, videos, links, buttons, and embedded content.
Hosting & Delivery: We provide the infrastructure and hosting to make your Profile Page publicly accessible on the internet.
Analytics: Tools to view metrics related to your Profile Page's traffic and visitor engagement (available in varying detail based on your subscription plan).
Customization: Access to design themes, color palettes, font options, and layout controls.
Custom Domain Support: For Pro subscribers, the ability to connect a domain name you own to your Profile Page.
Technical Support: Access to help documentation and, for certain plans, direct customer support.
No Guarantee of Uptime: While we strive for high availability, Profile Info does not guarantee that the Services will be uninterrupted, timely, secure, or error-free. The Services are provided on an "as is" and "as available" basis. We may perform scheduled or unscheduled maintenance, which may result in temporary service interruptions.
Evolution of Service: We continuously innovate and improve the Services. We may add, modify, or remove features, functionalities, or content at any time, with or without notice. This includes the right to discontinue, temporarily or permanently, any Service or any feature within it.
Third-Party Dependencies: The Services may rely on, integrate with, or display content from third-party services (e.g., social media platforms, video hosts, payment processors). Profile Info is not responsible for the operation, availability, or content of these third-party services. Your use of such third-party services is governed by their respective terms and policies.
Profile Info offers both free and paid subscription plans ("Pro Plan"). The features, limitations (such as the number of Profile Pages, access to premium themes, or depth of analytics), and pricing for each plan are detailed on our Pricing page. We reserve the right to change our subscription fees at any time. Any fee change will become effective at the start of the next subscription period following the notice of change. Your continued use of the Pro Plan after the fee change constitutes your agreement to pay the modified amount.
To access most features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You may not: (a) create an account for anyone other than yourself without permission; (b) create an account using a false identity or pseudonym, or provide information intended to mislead as to your identity; (c) create more than one personal account without explicit permission; or (d) create an account if you have been previously banned from the Services.
You are solely responsible for all activities that occur under your account and for maintaining the confidentiality and security of your account credentials, including your password. You agree to notify Profile Info immediately of any unauthorized use of your account or any other breach of security. You may be held liable for losses incurred by Profile Info or any other user of the Services due to someone else using your account, with or without your knowledge, unless such use is due to our direct security breach.
Profile Info reserves the right to: (a) refuse service, suspend, or terminate accounts; (b) remove or edit content; or (c) cancel orders in its sole discretion, including but not limited to violations of these Terms, fraudulent or illegal activity, or non-payment of fees.
You retain all ownership rights to the text, images, graphics, videos, audio, code, and any other materials you upload, post, publish, display, or otherwise make available through the Services ("User Content"). By making User Content available through the Services, you grant Profile Info a worldwide, non-exclusive, royalty-free, sublicensable (through multiple tiers), and transferable license to use, copy, modify (for technical purposes, such as formatting for display), distribute, publicly perform, and publicly display your User Content solely for the purpose of operating, providing, promoting, and improving the Services. This license terminates when you delete your User Content from our systems, except: (a) to the extent you shared it with others and they copied or stored it; and (b) for the reasonable time it takes to remove it from backup and other systems.
You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:
You own or have the necessary licenses, rights, consents, and permissions to use and authorize Profile Info to use all intellectual property rights in and to your User Content as contemplated by these Terms.
Your User Content, and its use by Profile Info and other users as permitted by these Terms, does not and will not:
Infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
Slander, defame, libel, or invade the right of privacy, publicity, or other property rights of any other person.
Contain any material that is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, sexually explicit, libelous, invasive of another's privacy, hateful racially, ethnically, or otherwise objectionable.
Promote violence, terrorism, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Contain illegal instructions, such as instructions for building weapons or committing crimes.
Constitute unsolicited or unauthorized advertising, promotional materials, commercial activities, "junk mail," "spam," "chain letters," "pyramid schemes," "phishing," or any other form of solicitation.
Contain software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Involve commercial activities not expressly approved by Profile Info, such as contests, sweepstakes, or barter.
Profile Info does not pre-screen User Content, but we have the right (but not the obligation) to monitor, review, edit, remove, or disable access to any User Content at our sole discretion for any reason, including if we believe such User Content violates these Terms, is objectionable, or may harm the Services, other users, or third parties. We may also remove or refuse to display User Content that we reasonably believe may create liability for us or violate applicable law. However, you acknowledge that Profile Info is under no obligation to monitor or control User Content and is not responsible for its content, accuracy, or legality.
The Services, including their "look and feel" (e.g., text, graphics, images, logos, page headers, button icons, scripts, and service names), underlying source code, software, databases, functionality, design, and all content created and provided by Profile Info (excluding User Content) ("Profile Info Content") are the exclusive property of Profile Info or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. The Profile Info name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Profile Info or its affiliates or licensors. You may not use such marks without our prior written permission. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and Profile Info Content for your personal or internal business purposes as intended by the Service's functionality.
You agree not to use the Services to:
Violate any applicable law, regulation, or contractual obligation.
Infringe upon the intellectual property, privacy, or other rights of Profile Info or any third party.
Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
Attempt to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services through hacking, password mining, or any other means.
Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission, or bypass any measures we may use to prevent or restrict access to the Services.
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the Services, except as permitted by applicable law.
Modify, adapt, translate, or create derivative works based on the Services or any Profile Info Content.
Remove any copyright, trademark, or other proprietary notices from any portion of the Services.
Use the Services to transmit any worms, viruses, Trojans, or other malicious or destructive code.
Use the Services for any benchmarking or competitive analysis, or to develop a competing product or service.
Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of Profile Info without express written consent.
Use meta tags or other "hidden text" utilizing Profile Info's name or trademarks.
Your Profile Page must not:
Be used primarily for the purpose of driving traffic to a separate commercial website or online service that competes directly with Profile Info's core offering of a centralized digital identity/profile hub.
Contain excessive, automated, or misleading advertisements.
Function as a proxy or anonymous gateway for other websites.
Engage in or promote "get-rich-quick" schemes, multi-level marketing, pyramid schemes, or similar ventures.
Be used for the primary purpose of hosting and distributing copyrighted material without authorization.
Serve as a platform for conducting surveys, contests, or lotteries without complying with all applicable laws and obtaining our prior consent.
Our Pro Plan is offered on a subscription basis ("Subscription"). By selecting a Pro Plan, you agree to pay the applicable subscription fees, which may be billed on a monthly or annual basis as selected by you. Subscription fees are non-refundable except as expressly set forth in these Terms. You authorize Profile Info to charge your chosen payment method (credit card, debit card, or other approved payment method) for all fees incurred. Fees are payable in U.S. Dollars unless otherwise stated.
Your Subscription will automatically renew at the end of each billing cycle (monthly or annually) unless you cancel your Subscription before the renewal date. You can cancel your Subscription at any time via your account settings. Upon cancellation, you will continue to have access to Pro features until the end of your pre-paid billing period, after which your account will revert to the Free Plan features.
Profile Info may change the price for Pro Subscriptions from time to time. Any price change will be communicated to you at least 30 days in advance via email. Your continued use of the Pro Plan after the price change goes into effect constitutes your agreement to pay the new amount.
You are responsible for paying all taxes, government charges, and levies (excluding taxes based on Profile Info's net income) associated with your use of the Services where legally applicable. In certain jurisdictions, we may be required to collect and remit such taxes.
Payments for the Pro Plan are non-refundable. We do not provide refunds or credits for partial subscription periods, unused time, or if you decide to stop using the Services during an active billing period, unless required by applicable law. If you believe a refund is legally required, please contact us.
The Service allows Pro subscribers to connect a domain name they own ("Custom Domain") to their Profile Page. You represent and warrant that you own or have the legal right to use any Custom Domain you connect. You are solely responsible for: (a) the registration, renewal, and management of your Custom Domain with a third-party registrar; (b) correctly configuring the DNS (Domain Name System) settings for your domain as instructed by Profile Info; and (c) any fees charged by the domain registrar.
Profile Info will provide instructions for configuring your domain's DNS records (typically CNAME or A records) to point to our servers. You are responsible for implementing these changes. Profile Info will automatically provision a free SSL/TLS certificate for your Custom Domain to enable secure (HTTPS) connections. We do not guarantee the issuance or renewal of these certificates, which depend on the policies of certificate authorities and your correct DNS configuration. You agree not to use a Custom Domain that infringes on any third-party rights.
Upon termination of your Pro Subscription or your account, your Profile Page will become inaccessible via the Custom Domain and will revert to being accessible only via a Profile Info subdomain (e.g., yourname.profileinfo.space). It is your responsibility to update your DNS settings with your registrar to point the domain elsewhere if desired.
The Services may display, include, or make available third-party content (including data, information, applications, and other products services) or provide links to third-party websites or services ("Third-Party Services"). You acknowledge and agree that Profile Info is not responsible for Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof. Profile Info does not assume and will not have any liability or responsibility to you or any other person or entity for any Third-Party Services.
Your use of Third-Party Services is solely between you and the applicable third-party provider. You must comply with the terms and conditions of any Third-Party Services you access through the Services. Profile Info does not endorse any Third-Party Services. Any dealings you have with third parties while using the Services are between you and the third party. Profile Info shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Third-Party Services.
When you embed content from a Third-Party Service (e.g., a YouTube video, a Twitter feed) on your Profile Page, you are subject to that service's terms of use and embedding policies. You are responsible for ensuring your embedding complies with their rules. Profile Info may use APIs and other interfaces provided by third parties to enable integrations. Your use of such integrations may be subject to additional terms from those third parties.
Our collection, use, and disclosure of personal information in connection with the Services is governed by our Privacy Policy. By using the Services, you consent to our collection and use of personal data as outlined in the Privacy Policy.
For users who are subject to data protection laws such as the GDPR (General Data Protection Regulation), we offer a Data Processing Addendum ("DPA") that outlines our respective obligations regarding the processing of personal data. The DPA is incorporated into these Terms by this reference. To request a signed copy of our DPA, please contact us.
If your User Content contains personal data of other individuals (e.g., client information in a case study, testimonials, team photos), you are responsible for ensuring you have a lawful basis to collect, process, and display that data, and for complying with all applicable privacy laws. You represent and warrant that you have obtained all necessary consents and provided all required notices to such individuals. Profile Info acts as a data processor for such data only to the extent of hosting and displaying it as you instruct. You are the data controller.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. PROFILE INFO SPECIFICALLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. PROFILE INFO DOES NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PROFILE INFO, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES. UNDER NO CIRCUMSTANCES WILL PROFILE INFO'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES (WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER THEORY) EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO PROFILE INFO FOR USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
THE LIMITATIONS IN THIS SECTION 10 APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, PROFILE INFO'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Profile Info, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Services, including but not limited to your interaction with any other user; (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (e) your violation of any applicable law, rule, or regulation. Profile Info reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Profile Info in asserting any available defenses.
You may terminate your account and these Terms at any time by following the account closure instructions within the Services or by contacting customer support. Upon termination, your right to use the Services will immediately cease.
We may suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including if: (a) you breach any provision of these Terms; (b) we are required to do so by law; (c) we discontinue the Services; or (d) you engage in conduct that we believe, in our sole discretion, is harmful to the Services, other users, or our business interests.
Upon termination of your account:
Your right to access and use the Services, including your Profile Page(s), will terminate.
We may, but are not obligated to, delete your User Content and account information from our live databases. Residual copies may remain in our backup systems for a period of time.
Any provisions of these Terms that, by their nature, should survive termination (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability) shall survive.
You will not be entitled to any refund of prepaid fees, except as required by applicable law.
These Terms and any action related thereto will be governed and interpreted by and under the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
Before filing a claim against Profile Info, you agree to try to resolve the dispute informally by contacting us at legal@profileinfo.space. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Profile Info may bring a formal proceeding.
Mandatory Binding Arbitration. You and Profile Info agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth below. The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules. The arbitration will be held in Wilmington, Delaware, or any other location we agree to. The AAA rules will govern payment of all filing, administration, and arbitrator fees. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction.
Exceptions to Arbitration. Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in the informal dispute resolution or arbitration process described above. Either party may also sue in small claims court if the claim qualifies.
No Class Actions. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed under these Terms.
For any legal actions not subject to mandatory arbitration (as outlined above), you and Profile Info consent to the personal and exclusive jurisdiction of and venue in the state and federal courts located in New Castle County, Delaware, for any litigation arising out of or relating to these Terms or the Services.
These Terms, together with the Privacy Policy, Cookie Policy, and any referenced DPA or Supplemental Terms, constitute the entire and exclusive understanding and agreement between Profile Info and you regarding the Services and supersede and replace any and all prior oral or written understandings or agreements between Profile Info and you regarding the Services.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision will be modified to reflect the parties' original intention or, if modification is not possible, severed from these Terms, and the remaining provisions will remain in full force and effect.
The failure of Profile Info to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Profile Info.
You may not assign or transfer these Terms, by operation of law or otherwise, without Profile Info's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Profile Info may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
Any notices or other communications provided by Profile Info under these Terms, including those regarding modifications to these Terms, will be given: (a) via email to the address associated with your account; or (b) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted. It is your responsibility to keep your account contact information current.
Profile Info will not be liable for any failure or delay in performance on account of events beyond its reasonable control, which may include denial-of-service attacks, internet or telecommunications failures, earthquakes, fire, flood, war, acts of terror, strikes or labor problems, riots, governmental action, or pandemics.
The parties are independent contractors. These Terms do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the parties.
There are no third-party beneficiaries to these Terms.
The English language version of these Terms is the controlling version. Any translated version is provided for convenience only and will not be used to interpret these Terms.
